These Terms & Conditions apply to all offers, orders, products and services supplied by:

1. Definitions

Mebocare: Mebocare BV.

Customer: Any natural person or legal entity purchasing products or services from Mebocare.

Consumer: A Customer acting for purposes outside their trade, business or profession.

Business Customer: A Customer acting in the course of a trade, profession or business.

Agreement: Any agreement between Mebocare and the Customer.

Products: All products offered by Mebocare, including but not limited to WristWidget®, 3NS Tex Tape and related accessories.

2. Applicability

These Terms & Conditions apply to all offers, quotations, orders, deliveries and agreements between Mebocare and the Customer.

Any terms and conditions used by the Customer are expressly rejected unless accepted by Mebocare in writing.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

3. Offers and Orders

All offers made by Mebocare are non-binding and subject to availability.

Product descriptions, images, specifications and pricing are provided with reasonable care. Minor variations in colour, packaging, appearance or design shall not constitute a defect.

Obvious errors, typographical mistakes, pricing errors or technical inaccuracies do not bind Mebocare.

An Agreement is concluded once Mebocare confirms the order or commences processing the order.

Mebocare reserves the right to refuse or cancel orders where there is reasonable cause to do so.

4. Prices

Unless stated otherwise:

  • Consumer prices include VAT where applicable.
  • Business prices are exclusive of VAT.
  • Shipping charges are shown separately where applicable.

Mebocare reserves the right to correct obvious pricing errors.

Prices may be adjusted due to changes in taxes, duties, legislation, transport costs, supplier pricing or currency fluctuations.

5. Payment

Payment terms are stated during checkout or on the invoice.

Unless otherwise agreed:

  • Consumer orders must be paid before shipment.
  • Business invoices are payable within 14 days.

Late payments may result in suspension of deliveries and services.

Business Customers are responsible for all collection costs incurred due to late payment.

Mebocare may charge statutory interest on overdue amounts.

6. Delivery

Delivery dates are estimates only.

Mebocare will make reasonable efforts to meet estimated delivery times but cannot guarantee exact delivery dates.

Orders are shipped to the address provided by the Customer.

Risk of loss or damage passes to the Customer upon delivery.

Mebocare is not liable for delays caused by:

  • postal services;
  • courier services;
  • customs procedures;
  • strikes;
  • force majeure events;
  • incorrect address information provided by the Customer.

7. International Orders

Customers outside the European Union are responsible for:

  • import duties;
  • customs fees;
  • local taxes;
  • brokerage charges.

Mebocare has no control over such charges and cannot predict their amount.

Orders refused by customs or refused by the Customer after shipment may be subject to return shipping costs and administrative charges.

8. Returns and Right of Withdrawal

Consumers

Consumers located within the European Union may withdraw from a distance purchase within 14 days after receiving the goods.

The Customer must notify Mebocare of the withdrawal within the applicable period.

Products must be returned:

  • unused;
  • complete;
  • in their original packaging where reasonably possible.

The Customer is responsible for return shipping costs unless otherwise agreed.

Refunds will be made within 14 days after receipt of the returned goods or proof of return shipment.

Exclusions

The right of withdrawal does not apply where permitted by law, including:

  • customised products;
  • personalised products;
  • sealed hygiene products that have been opened after delivery;
  • products made to Customer specifications.

Business Customers

Business Customers do not have a statutory right of withdrawal.

9. Product Compliance and Warranty

Mebocare warrants that products substantially conform to their published specifications.

Warranty does not cover:

  • normal wear and tear;
  • misuse;
  • improper storage;
  • modifications by the Customer;
  • damage caused by accidents.

Any claim must be reported within a reasonable time after discovery.

Mebocare may choose to:

  • repair;
  • replace;
  • refund;

at its sole discretion.

10. Medical Disclaimer

Mebocare products are intended to support treatment, rehabilitation and physical therapy.

Products sold by Mebocare:

  • are not medicines;
  • do not replace professional medical advice;
  • do not replace diagnosis by a healthcare professional.

Customers should consult a qualified healthcare provider regarding diagnosis and treatment decisions.

Mebocare makes no guarantee regarding specific medical outcomes.

11. Intellectual Property

All intellectual property rights relating to:

  • trademarks;
  • product names;
  • logos;
  • designs;
  • texts;
  • photographs;
  • manuals;
  • website content;

remain the exclusive property of Mebocare or its licensors.

Nothing in these Terms grants ownership rights to the Customer.

No content may be copied, reproduced, distributed or used commercially without prior written permission.

12. Privacy and Data Protection

Mebocare processes personal data in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR).

Personal data is processed solely for:

  • order processing;
  • customer service;
  • legal compliance;
  • business administration.

13. Complaints

Customers should submit complaints by email to:

info@mebocare.com

Complaints should contain:

  • customer details;
  • order number;
  • description of the issue;
  • supporting photographs where relevant.

Mebocare aims to respond within 14 days.

14. Limitation of Liability

To the maximum extent permitted by law:

Mebocare shall not be liable for:

  • indirect damages;
  • consequential damages;
  • loss of profit;
  • loss of business;
  • loss of revenue;
  • loss of data.

Mebocare’s total liability shall never exceed the amount paid for the relevant order.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. Force Majeure

Mebocare shall not be liable for any failure or delay caused by circumstances beyond its reasonable control, including:

  • natural disasters;
  • pandemics;
  • war;
  • governmental actions;
  • transport disruptions;
  • internet failures;
  • supplier shortages.

During such events, Mebocare may suspend its obligations for the duration of the force majeure situation.

16. Governing Law and Jurisdiction

These Terms and all Agreements are governed exclusively by the laws of The Netherlands.

Any dispute arising from or related to these Terms shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
